Drug-price declaration, winning tender prices, and the price-management framework under the 2023 Price Law and the 2024 Pharmacy Law amendment.

Overview

This section is a Vietnam-focused reference for drug-price management, declaration regimes, and the relationship between declared prices, tender prices, and reimbursement. Scope: • Declared wholesale price (giá bán buôn thuốc dự kiến) — the new regime under the amended Pharmacy Law, declared to the Drug Administration of Vietnam (DAV). • Essential-medicines price declaration under the 2023 Price Law and Decree 85/2024/NĐ-CP — managed by the Ministry of Health, with the eligible list set out in Circular 28/2024/TT-BYT. • Winning tender prices (giá trúng thầu) — published by DAV and Vietnam Social Security; cross-reference with public-procurement rules under Circular 40/2025/TT-BYT (see Tendering & Market Access). • Price negotiation route (đàm phán giá) — for selected high-cost or sole-source medicines; list under Circular 05/2024/TT-BYT (as amended by Circular 37/2025/TT-BYT). • Public price-search portals operated by DAV and the Ministry of Health transparency portal (Cổng công khai y tế). Important: as of 1 July 2024, the drug-pricing provisions of Decree 54/2017/NĐ-CP were repealed and replaced by the 2023 Price Law framework. The amended Pharmacy Law (44/2024/QH15, effective 1 July 2025) then introduced the new declared-wholesale-price regime, which runs in parallel with the Price Law's essential-medicines declaration. The two regimes use different lists and different declarants.

Price Law framework: • Price Law No. 16/2023/QH15 — passed 19 June 2023, effective 1 July 2024. Replaces the 2012 Price Law (11/2012/QH13). Essential medicines used at healthcare facilities are listed in Section 9, Appendix I. • Decree 85/2024/NĐ-CP — implements the Price Law, including drug price declaration procedures. Price negotiation: • Circular 05/2024/TT-BYT (14 May 2024) — list of drugs, medical devices, and test equipment procured through price negotiation, and supplier-selection procedures for price-negotiation packages. • Circular 37/2025/TT-BYT — amends and supplements Circular 05/2024/TT-BYT. Tender pricing (cross-reference): • Circular 40/2025/TT-BYT — drug bidding at public medical facilities (see Tendering & Market Access). Repealed: • Decree 54/2017/NĐ-CP — drug-pricing provisions repealed effective 1 July 2024; other provisions of the decree remain in force for non-pricing matters.

Recent updates

2025 — New declared wholesale price regime: Effective 1 July 2025 under Law 44/2024/QH15, drug importers, manufacturers, and contract manufacturers must declare a "giá bán buôn thuốc dự kiến" (intended wholesale price) to DAV before circulation and re-declare on change. This regime runs in parallel with — and distinct from — the Price Law's essential-medicines declaration. 2025 — Price negotiation list amended: Circular 37/2025/TT-BYT amended Circular 05/2024/TT-BYT, updating the list of medicines and supplies subject to price negotiation and refining supplier-selection procedures. 2024 — Price Law regime in force: On 1 July 2024, the Price Law 16/2023/QH15 took effect together with Decree 85/2024/NĐ-CP. The drug-pricing provisions of Decree 54/2017/NĐ-CP were repealed. Circular 28/2024/TT-BYT and DAV Dispatch 4448/BYT-QLD set out the transitional implementation for medicines required to declare prices. 2024 — Price-negotiation framework consolidated: Circular 05/2024/TT-BYT (14 May 2024) consolidated the rules and lists for price-negotiation procurement, replacing fragmented earlier guidance.
