Foreign-invested enterprise

A Vietnamese-incorporated enterprise with foreign equity, governed by the Investment Law and Enterprise Law. Sector rules vary sharply by industry. For pharmaceuticals, Article 53a of the Pharmacy Law (added by Law 44/2024/QH15) permits FIEs to import drugs and sell to wholesalers and defined hospitals, but restricts stand-alone wholesale and direct retail — preserving the WTO-commitment restriction. For medical devices, no equivalent restriction applies: FIEs may directly import, wholesale, retail, lease, install, warranty and service under Decree 98/2021/NĐ-CP.
